1. Golf Course Asset Acquisition Agreement (Sections 24, 25, 27 FOIP)

Action Items1. Golf Course Acquisition Agreement and 2021 Operations Over the course of a two-year period from June of 2017 to June of 2019, Town Administration and Council were made aware of financial challenges experienced by the Hinton Golfing Society (the Society). To assist the Society with continued golf operations, the Town of Hinton entered into a Loan Agreement with the Society in June of 2017. A condition of this Agreement included the transfer of all Golf Course assets to the Town in the event of default on the loan payments. In 2019, the Society defaulted on the payments as outlined in the 2017 Loan Agreement, triggering the transfer of assets process. In October of 2019, the Town allocated an additional $250,000 to the Society where funds were designated to support golf operations through the 2020 season. Conditions for the additional allocation included the hiring of a Director of Golf to ensure adequate course management, and financial oversight from Town Administration related to the use and repayment of the $250,000. At the May 5, 2020 Regular Council Meeting, Council directed Administration as follows: “That Council approve Administration to proceed with the Option 1 regarding the Golf Course Asset Acquisition Agreement as discussed in camera, and that Council direct Administration to bring the completed Golf Course Assets Acquisition Agreement back to an In Camera Regular Meeting of Council for approval”.
It was moved That Council approve the Asset Acquisition Agreement between the Town of Hinton and the Hinton Golf Society; and that Council direct Administration to proceed with establishing a one-year Operating Agreement with the Hinton Golf Society effective October 31/2020 – October 31/2021. This motion carried.
2. Fortis Franchise Fee This item is before Council to review the annual franchise fee that is part of the Electric Distribution Franchise Agreement. The franchise fee (or the local access fee) is charged to FortisAlberta which allows access to municipal lands to construct, maintain, and operate distribution systems. The fee is recovered by FortisAlberta as a local municipal access fee on electric billings of all customers that receive electric service in the municipal service area.
It was moved that Council approves a 0% increase to the Fortis Rider Fee for the 2021 year. This motion carried.

Following the return from in camera, the following motions were made: - That Council proceed with closure of the investigation as discussed In Camera regarding the code of conduct complaint received in July 2020.
- That Council conclude the investigation regarding the In Camera Item #2 Code of Conduct complaint on the October 6, 2020 agenda as discussed In Camera.
- That Council revisit In Camera Item #1 Code of Conduct motion to include that it relates to the first item on the October 6, 2020 In Camera agenda.
- Amend Item #1 Code of Conduct decision to indicate that it relates to the first Code of Conduct item on the October 6, 2020 In Camera agenda.
- That Council proceed with closure of the investigation of the October 6, 2020 In Camera agenda Item #1 as discussed In Camera regarding the code of conduct complaint received in July 2020.
These motions carried.

Information Items1. January 1 - August 31, 2020 Year to Date Financial Statements and Capital Project Plan UpdateFind more information here. Following the information item being presented, Council made motion That Council accept the January 1 – August 31, 2020 Year to Date Financial Statements and Capital Project Plan Update as information; this motion was postponed until a detailed capital budget has been presented to Council at a Regular Council meeting. Councillor Tyler Waugh: Councillor Waugh reported recent CEAC meetings, narrowing the scope of feedback to be soliciting including the determination of focusing on Town of Hinton COVID-19 response. Waugh then shared that Community Futures West Yellowhead received news from the federal government they would be responsible for distributing further regional relief funds. Councillor Trevor Haas: Councillor Haas detailed recent Library board meetings, moving towards a phase 4 opening which would allow small numbers of patrons to freely enter and peruse the building at a time. Haas also detailed a West Yellowhead Regional Waste Management Authority meeting which covered discussions of writing off delinquent accounts. Haas concluded about speaking to a number of recent Town of Hinton training opportunities and Strategic Planning meetings. Councillor Dewly Nelson: Councillor Nelson also spoke to the Community Futures West Yellowhead offices work in allocating federal relief funds, saying more than 1.5 million dollars in relief had been issued. Nelson then detailed attendance at an FCM Climate course, and involvement in the wetlands ad-hoc provincial groups creation of terms of reference for advocating on behalf of municipalities. Concluding, Nelson spoke first to COVID business visitation walks and the weekend Missing and Murdered Indigenous Womens and Girls REdress event. Councillor Ryan Maguhn: Councillor Maguhn spoke to the importance of the previously reported workshops and strategic planning session. Maguhn then detailed attendance at recent Golf Society meetings, saying earlier agenda items and personnel matters covered the bulk of discussion. Councillor JoAnn Race: Councillor Race detailed a recent ASH meeting, sharing pride at the management of the group through the pandemic. Race then detailed attendance in the business visitation walks, saying that beneficial conversations regarding business response to the pandemic were had.
Councillor Albert Ostashek: Councillor Ostashek shared attendance at the Destination Marketing Organization meeting, sharing appreciation for the presence of Hoteliers at the event. Ostashek then shared a number of upcoming meetings scheduled.
Mayor Marcel Michaels: Mayor Michaels shared appreciation to Council and Community Futures West Yellowhead for the Business VIsitation walks, and thanked for the updates, before moving on to say that AUMA was not as effective as usual due to the digital nature and lack of opportunities for networking. Michaels did share an appreciation for a sentiment shared by Premiere Kenney, encouraging municipalities to do everything possible to facilitate business in their community. Michaels then spoke to the strategic planning session, saying that the Strategic Plan coming from the session would bring deliverables and strategies to achieve them. Michaels also shared appreciation for the DMO meeting, as well as sharing an opportunity to attend the Evergreens facility in Edson grand opening and a brief tour of the facility and an upcoming opportunity for council to do the same. Michaels concluded by inviting members of the public and council to attend a coming speaking engagement at BSN.
CAO Emily Olsen: CAO Olsen was pleased to confirm the hiring of a new staff member to the role of Legislative Services, beginning in early November, and shared thanks to the community for their compliance and assistance in the water reduction required over the weekend for maintenance of the water treatment facility.

Minute with Council AccessEarly in the Town Response to COVID-19, Town Council meetings were moved to remote environments, closed to the public, and streamed online to allow for easy access by residents. However, one aspect of our Council meetings that was lost in this necessary response was Minute with Council.
Traditionally, Residents have been welcomed to speak to Council about issues, events, celebrations or concerns during Minute with Council. At the beginning of each Council Meeting, the chair of the meeting opens the floor to the public to speak and share with Council members, administration and meeting observers.
As we determine the "new normal" in this pandemic response, the Town of Hinton has established a procedure to take part in Minute with Council remotely, temporarily, as we prepare for further steps in our reopening plans.
This process is being established to avoid risks of public meeting teleconferencing, such as inappropriate or abusive interjections by anonymous or false identities.
